TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of www.witbee.com and its Analytics Brain platform at brain.witbee.com (collectively: the “Website”), together with the webinars, newsletters, knowledge-base content, and connectors we make available through it (collectively: the “Services”). By creating an Account, or by using the Website or Services in any other way, you agree to these Terms. If you do not agree, do not use the Website or Services.

Capitalized terms used but not defined here have the meaning given to them in our Privacy Policy, which forms part of your agreement with us.

I. Definitions

Website – www.witbee.com, brain.witbee.com, or their subdomains, managed by the Supplier.

Witbee (or Supplier) - WITBEE spółka z ograniczoną odpowiedzialnością z siedzibą w Warszawie, address: ul. Warszawy w Warszawie – XII Wydział Gospodarczy Krajowego Rejestru Sądowego, share capital: 30.000,00 PLN – the owner of the Website; Services provider.

Visitor - an individual other than a Client, who uses the public area of the Website and has no Account.

Client - a natural or legal person who has accepted these Terms and registered an Account.

Account - the Client's registered profile on the Website, protected by an email address and password, activated once the Client confirms their email.

Services - everything we make available through the Website: live and recorded webinars, newsletter issues, the knowledge base of guides and procedures, and connectors (including the Analytics Brain MCP connector) that let an AI assistant read that knowledge base on the Client's behalf.

Subscription - a paid plan that grants a Client access to Services beyond what a free Account already includes.

II. Accounts

To use most of the Services you need an Account. You register with a valid email address and a password, and confirm your email before you can sign in - an unconfirmed Account cannot be used.

You are responsible for keeping your password confidential and for everything that happens under your Account. Tell us immediately at info@witbee.com if you suspect someone else has access to it.

You must provide accurate information when you register, and keep it up to date. We may suspend or terminate an Account that was registered with false information, or that we reasonably believe is being used to violate these Terms.

A free Account gives you access to the published knowledge base and to whatever webinars and newsletter issues are open to all Clients. A Subscription unlocks additional Services, for as long as it stays active.

III. Using the Services

You may use the Services only for their intended purpose and only in ways that are lawful. You agree not to:

  • copy, resell, or redistribute Services or knowledge-base content beyond what your Account or Subscription permits;

  • use the Services to build a competing product, or to train a model on our content without our written permission;

  • attempt to access Services, groups, or content your Account is not granted, including by circumventing access controls;

  • interfere with the Website's operation, security, or availability, including through automated scraping that goes beyond normal use of a connector we provide for that purpose;

  • use the Services to violate the law, or the rights of Witbee or any third party.

We may remove content, suspend access, or terminate an Account that breaches this section.

IV. The Analytics Brain MCP connector

Analytics Brain also offers a connector, built on the Model Context Protocol, that lets an AI assistant you control search and read the published knowledge base on your behalf, scoped to what your own Account can already see.

The connector is read-only: it cannot create, change, or delete anything, and it has no access to your own analytics accounts, ad platforms, or data outside the knowledge base. Using the connector is subject to these Terms in the same way as using the Website directly - what your Account can see through the connector is exactly what it can see when signed in on the Website.

You are responsible for how the AI assistant or client you connect handles the content the connector returns to it; that is governed by the terms of whatever assistant or platform you use to connect, not by us.

V. Subscriptions and payments

Some Services require a paid Subscription, billed at the price and interval shown at checkout. Payments are processed by our payment provider; we do not store your full card details.

A Subscription renews automatically at the end of each billing period unless you cancel it before renewal, through your Account settings or by contacting info@witbee.com. Cancelling stops future renewals; it does not refund the period already paid for, except where applicable law requires otherwise.

If you are a consumer in the European Union, you may have a statutory right to withdraw from a distance contract within 14 days without giving a reason, under the conditions set out in applicable consumer protection law. Where a Subscription grants immediate access to digital content, starting to use that content with your prior express consent may affect this right, as provided by that law.

We may change Subscription prices for future billing periods; we will give you reasonable notice before a change takes effect on your Subscription.

VI. Intellectual property

The Website, the Services, and their content - including the knowledge base, webinars, and newsletters - are owned by Witbee or its licensors and protected by copyright and other intellectual property laws. Your Account gives you a personal, non-transferable licence to use them for your own purposes; it does not transfer any ownership to you.

You keep ownership of anything you submit to us (such as a support request or feedback), and you grant us a licence to use it to operate and improve the Services.

VII. Disclaimers

The Services are provided “as is”. Knowledge-base content, webinars, and newsletters reflect Witbee's own analysis and can date - we do our best to keep them accurate and current, but we do not guarantee that any specific piece of content is complete, error-free, or suited to your particular situation. Nothing in the Services is professional, financial, or legal advice.

We do not guarantee that the Website or Services will be available without interruption, or free of errors, and we may change, suspend, or discontinue any part of them.

VIII. Limitation of liability

To the extent permitted by applicable law, Witbee is not liable for indirect, incidental, or consequential damages arising from your use of the Website or Services. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or, where you are a consumer, liability that mandatory consumer protection law does not allow us to exclude.

IX. Termination

You may stop using the Services and close your Account at any time by contacting info@witbee.com. We may suspend or terminate your Account if you breach these Terms, with notice where reasonably possible. Sections that by their nature should survive termination - including intellectual property, disclaimers, and limitation of liability - continue to apply after your Account is closed.

X. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will make the updated Terms available through the Service and indicate the date of the latest revision. Continuing to use the Services after a revised version takes effect means you accept it.

XI. Governing law and contact

These Terms are governed by Polish law. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the competent Polish courts, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
